By accessing our website www.heritagemotorscompany.com, making a reservation, or using our services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our services.

Definitions

  • “Vehicle” means the car you rent from us.
  • “Rental Agreement” means the contract between you and us for the rental of a Vehicle.
  • “You” or “Your” refers to the person or entity renting a Vehicle from us.

Reservations and Rental Agreement

Reservations are subject to Vehicle availability and are not guaranteed until confirmed by us in writing.

The Rental Agreement is formed when you make a reservation and we confirm it. These Terms and Conditions form part of the Rental Agreement.

You must be at least 25 years old and possess a valid driver’s license to rent a Vehicle from us.

We reserve the right to refuse service to anyone for any reason not prohibited by law.

Rental Charges and Payments

  • Rental charges are based on the Vehicle model, rental duration, and any additional services or products you select.
  • A security deposit is required at the time of pickup. The amount will vary based on the Vehicle model and rental duration.

You agree to pay all charges incurred during your rental period, including but not limited to:

  • Daily or hourly rental rates
  • Mileage fees (if applicable)
  • Fuel charges (if the Vehicle is not returned with the same fuel level as at pickup)
  • Late return fees
  • Tolls and parking fees
  • Traffic or parking violation fines
  • Damage repair costs (subject to the selected insurance coverage)

3.4. We accept major credit cards for payment. Cash, debit cards, and prepaid cards are not accepted.

Vehicle Pickup and Return

  • You must present a valid driver’s license and credit card in your name at the time of pickup.
  • We will provide a Vehicle orientation at pickup. You are responsible for familiarizing yourself with the Vehicle’s operations.
  • You must return the Vehicle on the agreed date and time to the designated location.
  • Late returns may incur additional charges of up to one full day’s rental for each day or part thereof that the Vehicle is overdue.

Vehicle Use and Restrictions

  • The Vehicle must only be driven by the renter or additional drivers listed on the Rental Agreement.
  • You agree to use the Vehicle only for personal use and in accordance with all applicable laws and regulations.

The following are strictly prohibited:

  • Driving under the influence of alcohol, drugs, or any intoxicating substance
  • Using the Vehicle for any illegal purpose
  • Racing or speed testing
  • Carrying passengers or property for hire
  • Pushing or towing any vehicle or trailer
  • Driving on unpaved roads or off-road
  • Transporting animals (except service animals)
  • Smoking in the Vehicle

5.4. You agree not to remove the Vehicle from Europe without our prior written consent.

Insurance and Liability

  • Basic insurance coverage is included in the rental price. Additional coverage options are available for purchase.
  • You are responsible for any damage to the Vehicle during the rental period, subject to the terms of the selected insurance coverage.
  • We are not responsible for loss or damage to any personal belongings left in the Vehicle.
  • You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, or expenses arising out of your use of the Vehicle.

Breakdowns and Accidents

  • In case of a breakdown or accident, you must immediately contact our 24/7 support line and local authorities if necessary.
  • We will provide roadside assistance, but you may be responsible for any costs incurred due to driver error or negligence.
  • You must not attempt to repair the Vehicle without our express permission.

Cancellations and Modifications

  • Cancellation policies vary based on the type of reservation. Please refer to our Refund and Returns Policy for details.
  • Modifications to reservations are subject to Vehicle availability and may result in price adjustments.

Privacy and Data Protection

  • We collect and process your personal information in accordance with our Privacy Policy.
  • You consent to our use of electronic tracking technology in the Vehicle for security and inventory management purposes.

Governing Law and Dispute Resolution

  • These Terms and Conditions are governed by and construed in accordance with the laws of Europe.
  • Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Europe.

Modifications to Terms and Conditions

  • We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website.
  • Your continued use of our services after any changes to these Terms and Conditions constitutes your acceptance of such changes.

Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect and enforceable.
